The Mexican Telecommunications Law

Since 2014, Mexico has changed its relaxed position on internet regulation by introducing its very own data retention law, called the Telecommunications Law. In 2017, the Mexican government published the new Cybersecurity National Strategy and in 2021, a federal Mexican court ordered the FTI to issue the Guidelines for Network Operations with the neutrality principles in mind (free choice, non-discrimination, privacy, transparency). However, these two haven't brought any major changes in terms of online freedom in Mexico. 

Public telecommunications network licensees (and other authorized entities) still keep records of and are in control of the following data:

  • Names and addresses of their users
  • The origin and destination of communications
  • Date, time, and duration of the communications
  • Type of communication (voice, messaging, conference, or data exchange)
  • Digital locations of the geographic positioning of telephone lines

What's more, the protection, processing, and control of personal data are still regulated by the Data Protection Law (dating all the way to 2010). The heavily outdated law states that the processing of personal data is subject to the owner's consent. The consent, however, may be implied, which leaves a lot of space for misjudgment and abuse. Express consent is required only in case financial data is to be processed, and written consent is required only with sensitive information.
