Netflix’s terms of service (ToS) states that if it discovers anyone using a VPN to access another catalog, it will cut off their Netflix account. The reason for this is that although Netflix needs to be seen to be doing something to stop people accessing unlicensed content, it’s not in the company’s interest to cut subscribers off. Subscribers pay Netflix to use its service. Cutting someone off means less revenue for the firm.

Is It Illegal to Unblock Netflix?

This is a hotly contested point. Watching unlicensed content is technically piracy. As such, in places that are very tight on copyright control (such as Japan, Vietnam, Singapore, and similarly minded places), it is possible that you could get into trouble with the law.

However, this risk is minimal, because Netflix users who use a VPN did pay for their Netflix service. To date, we have never heard of anyone being prosecuted for using a VPN to unblock Netflix.

In the UK, for example, subscribers get to see 34% of content. Australian Netflix also suffers from a limited catalog. In Spain, subscribers get to see just 22% of the catalog.   1. So I live in mainland europe, but am from the UK, and want to use a VPN to access UK services such as iPlayer, which would also give me UK netflix. Is it possible to also have the same VPN to access US netflix and it’s bigger library as well? Or would I need to get 2 VPNs, one for each country, and switch between them? (I would probably prioritise UK and wouldn’t get 2 VPNs, just wanted to know if it was possible)

      The same VPN will work – just change VPN servers to the correct country. Do be sure, though, to take advantage of any free trials or money back guarantees to check the VPN service isn’t being blocked by Netfix (or any other service you want to access).

  4. I use NORDvpn. It does NOT allow me to watch JAPAN netflix from the US. They say they are working on it, and I know NETFLIX is trying to stop them.
    Just a bit frustrated that I had it all set up and working so my wife could watch NETFLIX in her native language.
    At least netflix could unlock the subtitles for all regions.
    Trying alternatives now, but no luck so far.

      Keeping up with this very fluid situation is hard. We are, however, working on a system to provide as much up-to-date information on VPNs and whether they work with key streaming services such as US Netflix and BBC iPlayer as possible. Mullvad worked fine with iPlayer when I reviewed it in July (and it has 3-hour free trial, so you can check for yourself).

  7. I have ExpressVPN, and experienced the same results as Ann. I’m in the USA and, while my ExpressVPN was active, could not unblock outside of the US. Simply put, it detected the VPN and stopped the attempted connection. I’m happy for anyone who is able to unblock while using ExpressVPN, but I experienced the same as Ann, and I imagine that we’re not the only two people who experience these results.

      I tested ExpressVPN with US Netflix less than two weeks ago, and it worked fine with then. I did find that the New York server didn’t work, but all other US servers did. As a backup, ExpressVPN includes a smart DNS service with its subscription. Again, I found this works fine for Netflix.

      ExpressVPN does usually work for US Netflix, but it is a continual game of cat-and-mouse. I would suggest trying again, and if it still does not work, then try using ExpressVPN’s smart DNS service(fee to all customers) instead.

    Region locking has nothing to do with Australian law. AT ALL!

    Q: Many Australians use a VPN to access Netflix in the US. Is it illegal for me to use a VPN to access Netflix?

    The Copyright Act does not make it illegal to use a VPN to access overseas content.
    While content providers often have in place international commercial arrangements to protect copyright in different countries or regions, which can result in ‘geoblocking’, circumventing this is not illegal under the Copyright Act.

    1. Hi there and thanks for your comment. While you may believe that unblocking geo-restricted content isn’t illegal you are in fact incorrect. Often I see it written on websites like Quora that it isn’t illegal to unblock geo-restricted content. However, the truth is different. The reason that Netflix can’t show the entire catalog in all zones is because of copyright restrictions placed on Netflix by content owners. Netflix wants to show all shows in all zones but it can’t because the shows are not licensed for certain zones. As such unblocking content is not only against the Netflix ToS but also against copyright laws. Admittedly, in Australia courts tend to be more lenient than say Japan. However, watching a copyright restricted show on Netflix is technically against the law and *could* get you in trouble. However, because Australian courts tend to decide that pirates should only have to pay for the actual amount of renting the movie and because subscribers who spoof to the US to watch shows on the fuller catalog have paid for their service: it is highly unlikely that Australian courts would punish Australians for breaking copyright. However, this is a national technicality that does not to apply to all nations. Finally, if you are using a VPN to spoof a US IP address and watch Netflix, why on earth would you want to do it on an insecure VPN, when you could do it on a secure VPN? And have peace of mind?

        Did you even see what the linked site was? That is the official website of the Australian Prime Minister (who incidentally is a lawyer), not some random social media site. The Prime Minister has explicitly stated that in Australia, bypassing Netflix’s protection systems is legal. That is a very clear statement that would stand up in any court. It is not simply that they won’t prosecute, it is not illegal.

        That part is wrong (in Australia). That’s a problem for Netflix, and that’s why they’ve had to add it to the ToS.
        Using a VPN clearly violates the ToS. No question about that. But in Australia it’s not piracy.

          I have just discussed this with Ray, and we have failed to reach agreement. In my view you are correct – in most countries it not illegal to stream content from even pirate websites, let alone from a service that you have actually paid for. Netflix is prevented from showing its whole catalog because of its copyright agreements with content producers. That does _not_ mean a subscriber is breaking the law by circumventing that restriction.

          No-one in any country has ever gone to jail for bypassing Netflix’s geoblocks. And I don’t think anyone has ever gone to jail even for streaming outright pirated content. Even in the UK, noted for its fairly draconian copyright laws, simply streaming even highly pirated content is probably not illegal.

          That said, Ray is perhaps correct to err on the side of caution. Readers should certainly check the laws of their own country if they are worried about the issue. As he notes,

          “If my article makes someone in the wrong country go to jail, i wont be best pleased that i didnt warn them – so its the minority that are most important in this situatiuon as they have something to lose.”

    A little while back your service suggested that ExpressVPN was the best one for use with Netflix. We live in a small city close to Seattle and I use a VPN for privacy, a little help with hack defense, ad-blocking and so forth. However ExpressVPN or PIA has NEVER worked with Netflix in our home network, even though I set it to Seattle, San Jose or LA (same time zone and best speeds).
    I’ve tried 4 different browsers (Firefox, Opera, Chrome, IE) and logging in to Netflix is always problematic. It works only with Chrome, never works with a VPN, and worse, I have to enter User-name & Password 3 times, <> I login. Well, we are set up with Express for 15 months through your service and it works well everywhere except for Netflix. I am really getting frustrated with Netflix OOOPS-errors, and am hoping you may have some ideas about getting a little better experience with that login.
    I do understand the never-ending battle between Netflix & VPNs and that things change back and forth. But in their price rise from $8.75 to $10, am feeling more in need of ideas. I’d really appreciate any light you can shed on Netflix login behaviors. 🙂

      I don’t know why you have had such problems with Netflix in general – seems very strange, and is something to take up with Netflix if you are paying for its service. As far as VAN-related problems are concerned – well, it seems that you are well aware of the situation. The only thing that I can say for certain is that I use AirVPN, and it works just fine with US Netflix…

    2. If you go to airvpn (dot) org/topic/23432-netflix/?hl=netflix – the guy says that AirVPN does not work with Netflix. His post is written on July 16. You however state on July 18 that AirVPN “works just fine.”

        It is true that AirVPN no longer works with Netflix. When I wrote that statement I had used AirVPN to watch Netflix recently and assumed it was still working. It seems I was in error.
